1. Agreement to Terms

By accessing or using Learn with Lucas services (including our website, subscription products, lessons, digital content, and automated social media tools), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

3. Services Offered

Learn with Lucas provides language learning services, including:

• Free Services: Weekly live lessons, basic practice materials, monthly story downloads, community access via Discord
• Supported Speaking (English): Monthly subscription (€5/month or €50/year) including extended practice guides, 5 monthly stories with audio, small group sessions, Discord supporter access, and 25% shop discount
• Ondersteund Spreken (Dutch): Monthly subscription (€8/month or €79.90/year) including extended practice guides, 5 monthly stories with audio, weekly small group sessions (max 10 participants), Discord supporter access, Thursday PDF early access, and 25% shop discount
• One-time Products: Individual story sets, story bundles, and other digital learning materials
• Private Lessons: Individual tutoring sessions for English and Dutch language learning
• Automated Instagram Tools: Keyword-triggered comment replies and direct messages on our Instagram accounts, delivering relevant links in response to specific comments

4. Automated Instagram Messaging

4.1 How It Works

When you comment on a Learn with Lucas Instagram post using specific keywords (such as "practice", "story", "oefen", or "verhaal"), our automated system may reply to your comment and send you a direct message containing a relevant link. This is an opt-in interaction triggered by your own comment.

4.2 Your Consent

By commenting with a trigger keyword on our posts, you acknowledge that you may receive an automated reply comment and/or direct message from our account. You can stop receiving these messages at any time by not using trigger keywords or by blocking our account.

4.3 Data Use

We use your Instagram user ID solely to deliver the requested message. We do not store this data permanently or use it for any other purpose. See our Privacy Policy for full details.

5. Subscription Terms

5.1 Payment and Billing

Subscriptions are billed on a recurring basis (monthly or yearly, depending on your selection) until you cancel. Payment is processed securely through our payment processors (Stripe, Xendit, or other authorized payment gateways).

5.2 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription price.

5.3 Price Changes

We reserve the right to change subscription prices with 30 days advance notice. Existing subscribers will be grandfathered at their current rate for the duration of their continuous subscription.

5.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at english@learnwithlucas.com. Cancellation takes effect at the end of your current billing period. You will retain access to subscription benefits until that date.

6. Free Services

We offer free weekly lessons, basic practice materials, and community access. We reserve the right to modify, suspend, or discontinue free services at any time without notice. Free services are provided "as is" without any guarantees.

7. User Accounts and Access

7.1 Account Creation

Some services require account creation. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

7.2 Discord and Community Access

Access to our Discord communities and group sessions requires adherence to community guidelines. We reserve the right to remove users who violate community standards or engage in disruptive behavior.

7.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or disrupt our services or community.

8. Intellectual Property

8.1 Our Content

All content provided through Learn with Lucas services (including lessons, stories, audio recordings, practice guides, and other materials) is protected by copyright and owned by Learn with Lucas or its content creators.

8.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use our content for personal language learning purposes only. You may not:

• Redistribute, sell, or commercially exploit our content
• Share your account credentials or subscription access with others
• Copy, modify, or create derivative works from our materials
• Remove copyright notices or branding from our content

8.3 Fair Use for Personal Learning

You may download and save materials for offline personal study. You may share short excerpts (up to 100 words) for educational discussion with proper attribution.

9. Refund Policy

9.1 Monthly Subscriptions

Monthly subscriptions include a 3-day money-back guarantee. After 3 days, monthly subscriptions are non-refundable. When you cancel, you retain access until the end of your current billing period with no additional charges.

9.2 Yearly Subscriptions

Yearly subscriptions include a 14-day money-back guarantee. If you request a refund within 14 days of purchase, you will receive a full refund. After 14 days, yearly subscriptions are non-refundable, but you retain access for the full 12-month period. You may cancel to prevent auto-renewal for the following year.

9.3 One-time Products

Digital products (story sets, bundles) are non-refundable after download or access. If you experience technical issues preventing access, contact us within 7 days for assistance or a refund.

9.4 Private Lessons

Unused hours in private lesson packages are 100% refundable. Hours that have already been completed are non-refundable. For exam prep packages, the additional exam prep fee is non-refundable once materials have been prepared. Cancellations with less than 24 hours notice forfeit that session.

9.6 Requesting a Refund

To request a refund, email english@learnwithlucas.com with your name, email address used for subscription, and reason for refund request. Refunds are processed within 5-7 business days.

10. Privacy and Data Protection

We collect and process personal information in accordance with GDPR and Dutch data protection laws. Your data is used solely to provide services, process payments, and communicate with you. We never sell your data to third parties. For details, see our Privacy Policy.

11. Disclaimers and Limitation of Liability

11.1 Educational Services

Learn with Lucas provides educational content and practice opportunities. We make no guarantees about specific learning outcomes, language proficiency gains, or exam results. Your progress depends on personal effort and practice.

11.2 Service Availability

We strive to maintain consistent service availability but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

11.3 Limitation of Liability

To the maximum extent permitted by law, Learn with Lucas shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for services in the 12 months preceding any claim.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify subscribers of material changes via email at least 30 days before they take effect. Continued use of services after changes constitutes acceptance of updated terms.

13. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the competent courts of the Netherlands.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Learn with Lucas regarding use of our services.
